Seyfarth’s Annette Tyman and Elizabeth Humphrey co-authored an article, “DOJ Doubles Down on DEI and Antidiscrimination Obligations for Recipients of Federal Funds,” in LexisNexis on August 5. The Seyfarth attorneys discussed how the US Department of Justice (DOJ) recently issued a memorandum offering additional clarity and guidance on Diversity, Equity, and Inclusion (DEI)-related programs and policies, including key considerations for employers.

“The DOJ memo signals an aggressive enforcement posture toward DEI initiatives that rely in any way on protected characteristics such as race or sex, underscoring that the federal government will ‘no longer’ turn a ‘blind eye’ to discriminatory practices.”
