Amazon recently announced new changes to its policies that allow sellers to enforce patents in ways never seen before on the platform. Sellers may now use a third party patent attorney to act as the judge and jury and determine whether another product on the platform infringes the seller’s patent. Meanwhile, trademark owners can avail themselves of the Amazon Brand Registry and a simple takedown procedure that can result in removal of infringing product listings within a matter of days.
During the upcoming CLE we will examine these new policies with a focus on the following:
- The procedure and rules surrounding the new “Utility Patent Neutral Evaluation” process
- The differences between enforcing patents through this procedure versus traditional litigation
- What to expect before, during, and after enforcing a patent through the Utility Patent Neutral Evaluation process
- Protections offered to brand owners through the Amazon Brand Registry
- Warning signs of fraudulent activity associated with your brand
- The procedure through which brand owners can petition for takedown of infringing product listings
