Howard Wexler and Kyle Winnick Analyze New Limits on Wage Violation Damages in NYLJ

The New York Law Journal published an article by Howard Wexler and Kyle Winnick, “New York Severely Curtails Damages for Certain Pay Frequency Violations.” The authors examine a significant 2025 development in New York wage law, where damages for late wage payments are now limited to interest, unless the employer has prior violations.

This change is expected to reduce the volume of lawsuits related to pay frequency violations. However, Wexler and Winnick note that several questions remain unresolved, including how the new standard will be applied, and which workers are covered under the revised framework.
