New York Law Journal Publishes Article by Howard Wexler and Kyle Winnick on New York’s Construction Reporting Pay Act
The New York Law Journal published an article on October 23 by Howard Wexler and Kyle Winnick: "New York Shifts More Scheduling Risk to Construction Employers.” The article, which also appears on Law.com, examines New York’s Construction Reporting Pay Act, which takes effect December 8, 2026, and creates new reporting-pay and shift-cancellation requirements for construction employers across the state.
Winnick and Wexler outline the new requirements for prevailing and non-prevailing wage construction work and discuss potential wage-and-hour exposure for noncompliance. They also highlight practical steps employers should consider, including reviewing scheduling and shift-notification practices, weather-related cancellation protocols, timekeeping and payroll procedures, and applicable collective bargaining agreements and prevailing wage schedules.
The authors emphasized the wider implications of the act, noting:
“More broadly, the law reflects a growing legislative trend toward requiring employers to bear a greater share of the economic burden associated with schedule changes, canceled shifts, and work interruptions.”
