Pam Devata was quoted in a May 12 story “How to Conduct Individualized Assessments in Background Checks” from SHRM on how to make sure a background screening process complies with EEOC guidance. Devata said that while the guidance is not law and can’t be enforced by law, if you don’t follow it, you could be ripe for an investigation by the EEOC or plaintiffs’ counsel.
