October 21, 2026 – Seyfarth Shaw LLP represented Cherry Street Energy, an Atlanta-based distributed power company that builds, buys, owns, and operates solar and power infrastructure across the Southeast, in a refinancing of and increase to its existing credit facility to support the company’s continued growth and the development and acquisition of solar projects across the Southeast.

The credit facilities, which closed October 15, include a revolving line of credit and term and delayed draw term loan commitments. Fifth Third Bank, National Association acted as administrative agent, left lead arranger and sole bookrunner for the credit facilities.

“We’re glad to have guided Cherry Street through this financing to support its next phase of growth,” said Whitney Schmidt, lead Seyfarth partner on the deal and co-chair of the firm’s Commercial Finance practice. “It has been a pleasure to continue working with the team as the company expands its business and portfolio of solar projects.”

“Cherry Street builds, buys, and owns power plants across the Southeast, and this expanded facility gives us more capital to invest in our customers,” said Michael Chanin, CEO of Cherry Street Energy. “Fifth Third and the lender group understand our model of long-term ownership and have backed our growth. Whitney and the Seyfarth team have worked alongside us for years. They understand how our business operates and helped us put a financing structure in place that supports the way we build, acquire, and own power plants for decades.”

Schmidt has worked with Cherry Street Energy since 2023, when she represented the company in connection with its prior credit facility.

“Seyfarth has been a wonderful partner over the years,” said Ashley Watson, Cherry Street Energy CFO. “Their team is highly capable and a pleasure to work with, and we appreciated their support throughout this refinance.”

The Seyfarth deal team, in addition to Schmidt, included associates Aly Audy and Jasmine Chen, as well as paralegal Deirdre Mangan.

Cherry Street Energy is an Atlanta-based distributed power company that builds, buys, owns, and operates solar and power infrastructure across the Southeast. Since 2015, Cherry Street has owned and operated the systems it builds and acquires for commercial, industrial, and institutional customers, who buy the power rather than the equipment.
