On Tuesday, June 6, 2023, Seyfarth attorney, Teddie Arnold, will moderate a panel during the Defense Industry Initiative 2023 Best Practices Forum. The panel will discuss Trends and Risk Areas for Contractors from a Government Perspective and Teddie will be joined by Courtney Edmonds, Leidos’ Chief Ethics & Compliance Officer and Deputy General Counsel, Jon Lighter, Deputy General Counsel and Suspension and Debarment Official at Defense Logistics Agency, and Cathy Kessmaier, Principal Deputy General Counsel and Acting Suspension & Debarment Officer Department of the Navy.

This panel will examine the emerging trends and risk areas for contractors from the perspective of the Government and industry. This panel aims to provide valuable insight to contractors in order to help them navigate the evolving landscape of procurement fraud. It will consist of a discussion regarding greatest areas of risk within the business, including labor mischarging, false claims and misrepresentation, cybersecurity, subcontractor/supplier risk, among other areas, and best practices for contractors to prevent, detect, mitigate and correct those risks. In particular, the panel will explore the voluntary and mandatory disclosure process, the timing and nature of disclosures, an overview of the various enforcement authorities within the Government and how contractors should interface with those authorities in light of identified non-compliance, including interactions with the Agency Suspension & Debarment Officials. The discussion will also touch on practices to adopt from recent DOJ guidance regarding contractor compliance programs, as well as industry best practices for program implementation. Perspectives will be provided from both Government and industry.
