The authors provide a practical framework for evaluating DEI programs in light of heightened scrutiny under Title VII, recent Supreme Court decisions, and evolving EEOC enforcement priorities. They outline common risk areas—such as restricted mentorship, networking, and development programs—and offer concrete design principles to help employers preserve inclusion goals while reducing legal exposure.
