Intellectual property litigation and other types of litigation have grown increasingly complex, whether it takes place in federal or state court trial or appellate court, before an arbitrator, or in other forums, and whether the client is an individual or a large corporation. Among other things, technology and the global economy have changed many aspects of litigation, including discovery. Owen helps clients avoid litigation altogether or, when litigation is unavoidable, navigate the challenges posed by all aspects of modern litigation in a wide variety of forums. Owen has a particular focus on intellectual property litigation, representing clients in pre-litigation disputes relating to trademarks and copyrights, as well as in enforcement litigation in federal court or arbitral forums. Owen is also a seasoned appellate litigator and a co-lead of Seyfarth’s Appellate Group, who helps clients preserve appeal issues at trial and navigate the appellate process once an appeal is taken, including determining which issues are most appropriate for appeal.  Owen has worked on high stakes appeals in federal and state appellate courts across the country and has deep experience with merits briefing, oral argument, motion practice, and procedural issues in appellate courts.

In addition to intellectual property disputes, Owen represents clients in disputes involving misappropriation of trade secrets, non-compete and non-solicitation agreements, breach of contract, real estate, breach of fiduciary duty, foreign sovereign immunity, non-party discovery, and much more. He has represented clients in a wide variety of industries and circumstances. In all cases, he dives deep to understand his clients’ businesses and industries to help advise them on how best to navigate challenging litigation. Coming of age during the rise of the internet and new technologies has also helped Owen marry traditional litigation techniques and strategies to those new technologies in order to benefit his clients.

Prior to joining Seyfarth, Owen was a litigator for four years at a leading multinational law firm in New York, where he worked on complex, high-stakes litigation in which hundreds of millions or more were at stake. Among other things, he worked on a four-week-long trial in the Southern District of New York in which the plaintiff sought over $1 billion in damages. Since joining Seyfarth, Owen has further deepened his litigation and trial experience, representing clients in multimillion-dollar cases that went all the way to trial or an arbitration hearing, as well as numerous cases that went through the entire discovery process before being resolved on summary judgment. He is particularly adept at navigating the procedural quirks of appellate courts, especially in New York federal and state courts. Owen has represented clients in connection with disputes in forums throughout the country, including in California, Delaware, Illinois, Connecticut, Florida, New Jersey, and Idaho.   

In each case, Owen makes it his mission to learn the ins and outs of his clients’ businesses and industries so that he can advise them on how best to achieve an outcome that lines up with their business objectives. Owen also uses his familiarity with technology to benefit his clients, whether it is discovering information about their adversaries; dealing with technology-oriented discovery matters involving text messages, social media, and other web platforms; or simply using technology to deliver work product more efficiently.
