Jeffrey Ross was quoted in a July 23 story from Bloomberg BNA Daily Labor Report on the Supreme Court decision Texas Dept. of Housing v. Inclusive Communities. Ross said that Justice Kennedy’s emphasis on the importance of procedural safeguards to assure that the disparate impact theory is not abused is equally applicable in the employment context.
