Kyle Nelson and Jacob Roes Write on Risks Facing WA State Employers from Informal L&I Wage Guidance in HR.com
Seyfarth’s Kyle Nelson and Jacob Roes co-authored an article, “Cannabis Green Case: Informal L&I Warnings Can Now Trigger Lawsuits,” in HR.com on June 26. The Seyfarth attorneys discussed how the Cannabis Green case warns that Washington employers should treat all Labor & Industries wage guidance as potentially enforceable, since informal directives can now trigger legal action even without a formal wage order, and withholding pay records during L&I investigations may result in costly lawsuits and attorney fees.
“As Washington employers navigate the complex waters of wage complaints, the Supreme Court’s opinion serves as both a map and a warning. It is a story of informal directives wielding formal power, urging employers to steer their ships toward compliance and away from the rocky shores of litigation.”
