Mark advises employers on their legal challenges and protects their interests in administrative and judicial proceedings. He has nearly three decades of experience in almost every aspect of employment law, such as talent acquisition, onboarding, training, policy-setting, compliance, investigations, terminations, and transactional due diligence—and in virtually every setting, including within the organization, before governmental agencies, in mediation and arbitration, and in the courts. Early in his legal career, Mark served as a judicial clerk for David C. Winder, then-chief judge of the US District Court for the District of Utah.
Mark has significant experience advising clients through all phases in the employment field: background checks and hiring; employment and executive compensation agreements; policies and procedures; compensation and leave; drug and alcohol testing; privacy; workplace safety; discrimination, harassment, and retaliation; furloughs and employment terminations; protection of employer rights in intellectual property and confidential and proprietary information; and due-diligence in employment matters in mergers and acquisitions. Mark also represents employers in litigation in federal and state court; in arbitration and mediation; and in investigations, audits, and enforcement proceedings before state and federal agencies, such as the US Department of Justice, US Department of Labor, Equal Employment Opportunity Commission, and state anti-discrimination and safety and health administrations.
