Ashley Laken quoted in Bloomberg BNA Health Law Reporter, “Community Health Systems Loses in Effort To Avoid NLRB’s Award of Union’s Expenses”

Ashley Laken was quoted in a May 14 story from Bloomberg BNA Health Law Reporter on a recent federal appeals court ruling that said the National Labor Relations Board had authority to require a California hospital affiliated with Community Health Systems (CHS) to reimburse the contract negotiation expenses of a registered nurses’ union after the hospital failed to bargain in good faith. Laken said the court’s decision highlights the significant clubs the Board has at its disposal when health-care providers and other employers are found to have bargained in bad faith and the limited standard of review that courts will apply to the Board’s imposition of such remedies.
